Apple scored a major victory in its multi-country patent infringement battle against Samsung Electronics after a German court barred the Korean company from selling its Galaxy Tab 10.1 in the entire European Union except the Netherlands.”

“This is the second big setback for Samsung, which has been locked in a battle with Apple over smartphones and tablets patents since April, and comes after it delayed the Australian launch of its latest Galaxy tablet because of similar lawsuits.”

“Galaxy products use Google’s Android operating system, which directly competes with Apple’s mobile software.”

“Samsung is one of the fastest growing smartphone makers and has emerged as Apple’s strongest competitor in the booming tablet market with models in three sizes.”

” “Samsung is one of the few OEMs in the world with ability to enjoy success in both the smartphone and tablet markets,” “

“”Apple said that Galaxy line of mobile phones and tablets “slavishly” copied the iPhone and iPad. It has sued in the United States, Australia and elsewhere. Samsung has countersued Apple. “”

“”This is an intellectual property right granted by an agency of the European Union,” Florian Mueller, a technology specialist and blogger on patent battles, said on his blog FOSS Patents. “It can therefore be enforced on an EU-wide basis, while European patent law is still fragmented, requiring a different lawsuit in each country in which one seeks to enforce it.””

“”Success in the United States is the proof required to say you have global success,” said He Shiyou, executive vice president of ZTE and head of the firm’s terminals division.”

“”It’s like if you want to become a global film star. You have to go to Hollywood. There is no film star that is a global film star and not known in Hollywood,” He said.  ”

“With smartphones now accounting for more than 50 percent of handsets in the world’s biggest economy, there should be increased opportunities.”

” “But at this point in time, when the penetration rate in the U.S. is exceeding 50 percent, when it comes to the next level of penetration, I do think some people would want a lower-priced  smartphone.” “

“Apple and Samsung Electronics ended Nokia’s 15-year reign at the top of the smartphone sales rankings in the second quarter, researchers said on Friday. ”

“Nokia had dominated the smartphone market ever since its 1996 launch of the Communicator model, but competition from its two nearest rivals and a slump in its own sales knocked it from first to third place in the three months to June as growth in the sector slows.”

“”For ZTE, we are watching Apple. Apple is number one and Samsung is number two in the world, so there will definitely be competition,” said He, adding that ZTE has increased research and product development to better position the firm for developed markets.”

“The case against IP (Intellectual Property) is not hard to make; patent and copyright (say) are artificial state-granted monopoly privileges that undercut and invade property rights.”
